The following is a response by southern experts Florida Personal Injury Lawyer, Joseph M. Maus, and from AllExperts.com, a free Q & A service in the internet:

Subject: slipped on the ice breaking ball

Question:
On January 11, 2010, was walking in the parking lot of an office complex. I slipped on the ice (the sprinklers had been turned on) and broke her kneecap in three places. I had surgery, but as of this date (10 March) I'm still in a wheelchair. My orthopedic surgeon is waiting for me "almost complete recovery," but surely get arthritis in that knee. In this other types of surgery can still point. Do I have a case? This is in Florida

Answer:
Usually when I see a question like yours is ie, slipped and fell due to ice in a parking lot that can boast demand as a result from somewhere in the north. But after the winter we've had here in Florida, injury by accident as it probably occurred quite frequently.

In my opinion, you have a case. The best advice I can give you is to talk to a lawyer specializing in liability claims by locals, ie, slip and falls. You may be advised how best to proceed on maximizing your claim.

Generally, a landlord owes two duties to persons lawfully on the property – the property is maintained in a reasonably safe condition and to warn people in the ownership of dangerous conditions that the person may not be able to appreciate. Frost and ice are big business in Florida, and usually when there is a threat any, warnings are in the news. The owner / manager of the office complex knowledge or should have known that when the weather gets as cold as it has been lately, and then he / she runs the risk, there is a good chance there will be ice on the ground. If the complex is inviting people into their premises for commercial purposes then the owner / manager should have taken reasonable steps to get rid if the ice, or make a safety for people entering and leaving property.

You should talk to a lawyer slip and fall quite quickly to claim the debt. Slip and fall accidents are something of a specialty for manage successfully. There are many steps that his lawyer should take now, that is, notify the insurance companies for the maintenance association, find out what types of coverage are available, and if there are other entities that may be responsible, ie the complex may have a management company or maintenance company was called to clear the parking lot and the other company never responded. Your lawyer should also obtain photographs of the area where the accident occurred.

Most local lawyers specializing in liability claims handling claims on a contingent basis, ie lawyers share is a percentage of money they recover for you, and offer a free, no obligation consultation to discuss if you have a viable case. Usually do not have to pay anything in advance, and if there is no recovery, owes nothing. Therefore, you have nothing to lose at least talk with an accident lawyer. Just for my own experience with injury in South Florida, if I do not think a person has a viable case, I will say right up front. There is no point in creating false expectations and losing time and attorney time.

I think there is a claim that good and I would be happy to talk to you about how to proceed. Please call me Toll Free (866) 556-5529 or visit my South Florida personal injury website www.mauslawfirm.com.
